TERMS OF SERVICE

These Terms of Service (“Terms”) apply to your use of Beerstore.com.au (“Beerstore”, “we”, “us” or “our”), including browsing the website, creating an account, placing an order and purchasing products from us.
By accessing or using Beerstore.com.au, you agree to these Terms. If you do not agree with these Terms, you should not use the website or place an order.
These Terms apply to customers purchasing products for delivery or collection in Australia only.
1. OUR BUSINESS

Beerstore.com.au operates as a Victorian packaged-liquor retailer and sells alcohol in accordance with applicable Australian laws and regulations.
2. AUSTRALIAN CUSTOMERS ONLY
Beerstore.com.au currently accepts orders for delivery within Australia only.
We do not accept international orders or deliver alcohol outside Australia.
Where a product cannot legally be supplied or delivered to a particular location, we may refuse or cancel the affected order.
Different Australian states and territories may have different laws applying to the sale and delivery of alcohol. Where applicable, we will comply with the laws governing the sale and delivery of alcohol to the relevant destination.
3. ALCOHOL — 18+ ONLY
Alcohol may only be purchased and received by persons aged 18 years or older.
By placing an order for alcohol through Beerstore.com.au, you confirm that:
- you are at least 18 years of age;
- the information you provide to us is accurate;
- you are legally entitled to purchase and receive alcohol; and
- the purchase is being made for a lawful purpose.
You must not purchase alcohol on behalf of, or for the purpose of supplying alcohol to, a person under 18 years of age.
We may use age-verification, identity-verification and fraud-prevention procedures when processing an order.
We, our staff and/or our delivery providers may require valid photographic identification before an order is released, collected or delivered.
If satisfactory identification cannot be provided, or if the recipient is under 18, intoxicated or otherwise unable to lawfully receive the alcohol, delivery or collection may be refused.
We will comply with applicable liquor licensing and responsible-service requirements.
4. LICENCE
Beerstore.com.au operates under:
Victorian Packaged Liquor Licence No. 32001395
The licence applies to the licensed business and premises in accordance with its conditions.
Nothing in these Terms authorises the purchase, supply or delivery of alcohol in circumstances prohibited by applicable liquor laws or the conditions of our licence.
5. PLACING AN ORDER
When you submit an order through Beerstore.com.au, you are making an offer to purchase the products selected by you.
An order acknowledgement or automated email confirming receipt of your order does not necessarily mean that we have accepted your order.
We reserve the right to accept, decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- the product or price has been incorrectly displayed;
- payment cannot be successfully processed;
- we cannot verify the order or customer information;
- we reasonably suspect fraud or unauthorised payment;
- age or identity verification cannot be completed;
- the order cannot legally be supplied or delivered;
- the order would breach a liquor licence condition or applicable law;
- the requested delivery location is unavailable; or
- an order has been placed in circumstances suggesting misuse of the website.
A contract for the sale of products is formed when we accept your order for fulfilment.
6. PRODUCT AVAILABILITY
We make reasonable efforts to keep product availability on Beerstore.com.au accurate.
However, stock levels can change rapidly and a product may become unavailable between the time an order is placed and the time it is processed.
If an ordered product becomes unavailable, we may contact you to offer an alternative product.
If you do not wish to accept an alternative product, we will refund the amount paid for the unavailable product.
7. PRODUCT IMAGES, PACKAGING AND DESCRIPTIONS
We make reasonable efforts to ensure that product descriptions, photographs and other information displayed on Beerstore.com.au are accurate and current.
However, the actual product supplied may differ from the image displayed on the website.
This may occur because manufacturers and suppliers change:
- packaging;
- labels;
- bottle or can designs;
- branding;
- colours;
- product presentation;
- carton configuration;
- product specifications; or
- other aspects of product appearance.
Product photographs may also show an earlier version of packaging or a representative image.
For wine, the vintage displayed may also differ from the vintage supplied where the available stock has changed, provided the product supplied otherwise complies with the order and applicable law.
The actual product, label and packaging supplied may therefore differ from the photograph or image shown on Beerstore.com.au.
We may also use product images and descriptions supplied by manufacturers, distributors or other third parties.
We do not guarantee that every photograph, description or other product information will always be completely current.
Nothing in this section excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law.
8. PRODUCT INFORMATION
Alcohol content, product descriptions, ingredients, nutritional information, country of origin, vintage, volume and other product information may be supplied by manufacturers, distributors or other third parties.
While we take reasonable care when publishing this information, you should refer to the product packaging and label for the most current information.
If you have a specific allergy, dietary requirement or other product concern, please contact us before placing your order.
We do not guarantee that product information displayed online will remain identical to the information appearing on subsequently produced packaging.
9. PRODUCT SUBSTITUTIONS
We will generally contact you before substituting a product that you have ordered.
We will not intentionally substitute a product with a materially different product without your agreement, except where otherwise permitted by law.
If an alternative product is agreed, any relevant price difference will be communicated to you.
If an acceptable alternative cannot be supplied, we will refund the unavailable product.
10. PRICES
All prices are displayed in Australian dollars (AUD).
Unless otherwise stated, prices include applicable GST.
We take reasonable care to ensure that prices displayed on Beerstore.com.au are accurate.
Occasionally, errors may occur, including pricing, promotional, typographical or technical errors.
If a material pricing error is identified before an order is accepted, we may contact you and provide you with the option to proceed at the corrected price or cancel the affected order.
If an order has already been accepted, we will deal with the matter in accordance with applicable Australian law.
11. PROMOTIONS AND DISCOUNTS
Promotions, discounts and special offers may be subject to additional terms.
Unless otherwise stated:
- promotions are subject to stock availability;
- promotional prices apply only to eligible products;
- discounts cannot be combined unless expressly stated;
- quantity limits may apply;
- promotional offers may have an expiry date; and
- promotional offers may be withdrawn or amended where permitted by law.
Any specific conditions applying to a promotion will be displayed with the relevant offer.
12. PAYMENT
Payment must be made using one of the payment methods available through Beerstore.com.au.
Payments may be processed through third-party payment providers.
We may undertake reasonable fraud, security and payment-verification checks.
An order may not be fulfilled until payment has been successfully authorised.
We may cancel an order where payment is declined, reversed, disputed or otherwise cannot be verified.
13. FRAUD AND UNAUTHORISED TRANSACTIONS
We may undertake reasonable checks to protect customers and our business from fraudulent or unauthorised transactions.
These checks may include verifying:
- customer information;
- delivery information;
- payment information;
- order history;
- identification;
- contact details; or
- other information reasonably required to assess an order.
We may cancel or refuse an order where we reasonably suspect fraud, payment misuse, identity misuse or other unlawful activity.
Where a payment is subsequently disputed or reversed, we reserve our rights to investigate the transaction and pursue any remedies available to us under Australian law.
14. DELIVERY
Orders are generally delivered using Australia Post.
Delivery services, delivery requirements and available options may depend on the destination, product and applicable Australia Post service.

Delivery timeframes displayed on Beerstore.com.au are estimates only unless expressly stated otherwise.
15. DELIVERY ADDRESSES
You are responsible for providing a complete and accurate delivery address.
This includes:
- recipient’s full name;
- street address;
- suburb/locality;
- state or territory;
- postcode;
- apartment, unit or building details where applicable; and
- contact details.
We are not responsible for delays or failed delivery caused by incorrect, incomplete or outdated information supplied by you.
Where Australia Post cannot deliver to the address provided, the parcel may be taken to a collection location or returned to us in accordance with Australia Post’s applicable procedures.
16. AUSTRALIA POST ALCOHOL DELIVERY
Alcohol deliveries are subject to Australia Post’s applicable alcohol services and terms.
Australia Post may require the recipient to provide valid identification demonstrating that they are at least 18 years old.
Australia Post states that certain alcohol parcels can only be delivered to the person named as the addressee and that valid photo identification may be required. (Australia Post)
For Victorian deliveries, Australia Post also has specific declaration requirements for alcohol sent to an address in Victoria where the shipment is a gift or is being sent to a first-time recipient. (Australia Post)
You acknowledge that we do not control Australia Post’s identity-verification and delivery procedures.
17. NO SAFE DROP FOR ALCOHOL
Alcohol orders must not be left unattended where this would conflict with applicable law, Australia Post requirements or responsible-service obligations.
Australia Post’s current terms state that parcels containing alcohol will not be safe-dropped. (Australia Post)
An authority-to-leave instruction therefore does not override any applicable alcohol delivery, identification or signature requirement.
18. FAILED OR REFUSED DELIVERY
Delivery may be refused or unable to be completed where:
- the recipient is under 18;
- acceptable identification cannot be provided;
- the recipient is not the required addressee;
- the recipient appears intoxicated;
- the delivery address is incorrect or incomplete;
- the parcel cannot lawfully be delivered;
- the recipient refuses to accept the parcel;
- Australia Post’s delivery requirements cannot be satisfied; or
- another legal or operational restriction applies.
Where delivery cannot be completed, Australia Post may direct the parcel to a collection location or return it to us, depending on the circumstances.
Additional delivery, return or redelivery charges may apply where permitted by law.
Where a delivery is refused because of age, identification, intoxication or another legal requirement, we may be unable to refund delivery charges or other costs already incurred, to the extent permitted by law.
Nothing in this section limits any rights you have under the Australian Consumer Law.
19. DELIVERY DELAYS
We will make reasonable efforts to process and dispatch orders promptly.
However, delivery times can be affected by:
- Australia Post delays;
- weekends and public holidays;
- severe weather;
- natural disasters;
- transport disruptions;
- peak trading periods;
- remote-area delivery requirements;
- incorrect delivery information;
- product availability;
- payment verification;
- government restrictions; or
- other circumstances outside our reasonable control.
We are not responsible for delays caused by third-party delivery providers to the extent permitted by law.
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.
20. TRACKING
Where available, Australia Post tracking information will be provided to you.
Tracking information is generated and maintained by Australia Post and may not update immediately.
We may assist you with delivery enquiries where reasonably possible but cannot guarantee the accuracy or timing of third-party tracking information.
21. CLICK & COLLECT
Where Click & Collect is offered, collection will take place from the nominated collection location specified during checkout or in your order confirmation.
The person collecting an order may be required to provide:
- the order confirmation;
- valid photographic identification;
- information confirming their identity; and
- any other information reasonably required to verify the order.
Alcohol will only be released where the collection can lawfully be completed.
We may refuse collection where the person collecting the order:
- is under 18;
- cannot provide satisfactory identification;
- appears intoxicated;
- is not authorised to collect the order; or
- cannot satisfy another legal requirement.
22. RETURNS, REFUNDS AND AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.
Where a product has a major failure, you may have rights including a refund or replacement, subject to the circumstances and requirements of the Australian Consumer Law.
Where a product has a minor failure, we may be entitled to provide an appropriate remedy such as repair, replacement or refund in accordance with applicable law.
If you receive a product that is faulty, damaged, incorrect or otherwise does not comply with applicable consumer guarantees, please contact us.
We may request reasonable information, photographs or other evidence to assist with assessing your claim.

23. CHANGE-OF-MIND PURCHASES
Unless required by law, we are not required to provide a refund or exchange merely because you have changed your mind.
This includes circumstances where you:
- ordered the wrong product;
- ordered the wrong quantity;
- no longer want the product; or
- otherwise change your mind after placing an order.
We may offer a change-of-mind return or exchange at our discretion and subject to applicable conditions.
24. DAMAGED OR INCORRECT PRODUCTS
If your order arrives damaged, incomplete or contains an incorrect product, please contact us as soon as reasonably practicable.
Where appropriate, we may ask you to provide photographs of:
- the product;
- packaging;
- shipping carton;
- damage; or
- other relevant information.
We may need to investigate the matter with Australia Post or another delivery provider.
Where a product is damaged, faulty, incorrectly supplied or otherwise fails to comply with applicable consumer guarantees, we will provide an appropriate remedy in accordance with Australian law.
25. SHOPIFY
Beerstore.com.au is operated using the Shopify ecommerce platform.
Shopify provides technology and infrastructure used to operate our online store, including certain website, checkout, order-management, payment and related ecommerce services.
Your purchase is from Beerstore/Acland Cellars, not from Shopify.
Shopify is not the seller of the alcohol products offered through Beerstore.com.au and is not responsible for the products we sell, the fulfilment of your order or our compliance with Australian liquor laws.
Shopify states that merchants selling alcohol are responsible for complying with the laws applicable to their business and customers. (Shopify Help Center)
Shopify and other service providers may process information in connection with your use of our website and checkout. This is subject to applicable privacy policies and terms.
26. SHOPIFY SHOP AND THIRD-PARTY SALES CHANNELS
Beerstore.com.au may use Shopify features, apps, integrations or sales channels from time to time.
Availability of alcohol products through a particular Shopify sales channel is subject to the rules and restrictions applicable to that channel.
For example, Shopify currently identifies alcohol as an age-restricted product category that is prohibited from its Shop sales channel. (Shopify Help Center)
We may therefore restrict or disable particular Shopify sales channels or features for alcohol products where required by Shopify’s policies or applicable law.
27. THIRD-PARTY SERVICES
We may use third-party providers to operate Beerstore.com.au, including providers of:
- payment processing;
- fraud prevention;
- age and identity verification;
- delivery and logistics;
- website hosting;
- ecommerce technology;
- analytics;
- marketing;
- communications; and
- customer-support services.
Third-party providers may have their own terms and privacy policies.
Your use of Beerstore.com.au may therefore involve interactions with these providers where necessary to process and fulfil your order.
28. PRIVACY
We collect and use personal information where reasonably necessary to operate Beerstore.com.au and process your orders.

31. INTELLECTUAL PROPERTY
Unless otherwise stated, content appearing on Beerstore.com.au, including our:
- logos;
- branding;
- photographs;
- graphics;
- website design;
- text;
- promotional material; and
- original content
is owned by or licensed to us.
You may use the website for personal and lawful purposes, including purchasing products from us.
You must not reproduce, modify, distribute, sell or commercially exploit our website content without our prior written permission, except where permitted by law.
32. USER REVIEWS AND CONTENT
Where Beerstore.com.au permits customers to submit reviews, comments, photographs or other content, you agree that the content must:
- be genuine and based on your experience;
- not be misleading;
- not be unlawful or defamatory;
- not infringe another person’s intellectual property or privacy rights;
- not impersonate another person; and
- not be submitted for fraudulent or commercial purposes.
We may remove content that breaches these requirements or applicable law.
33. THIRD-PARTY LINKS

We are not responsible for the content, availability, security or privacy practices of third-party websites.
Your use of third-party websites is subject to their own terms and policies.
34. LIMITATION OF LIABILITY
To the maximum extent permitted by Australian law, we are not liable for loss or damage arising from circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any right, remedy or liability that cannot lawfully be excluded, restricted or modified under Australian law, including the Australian Consumer Law.
Where liability may lawfully be limited, our liability will be limited to the maximum extent permitted by law.
35. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay or failure to perform an obligation where the delay or failure results from circumstances beyond our reasonable control.
These circumstances may include:
- severe weather;
- natural disasters;
- fire;
- flood;
- transport disruption;
- postal disruption;
- industrial disputes;
- power or telecommunications failures;
- cyber incidents;
- government action;
- changes in laws or regulations;
- supplier failures; or
- other circumstances beyond our reasonable control.
This section does not limit your rights under the Australian Consumer Law.
36. CANCELLATION BY US
We may cancel an order where reasonably necessary, including where:
- a product is unavailable;
- a material pricing or product-listing error has occurred;
- payment cannot be processed;
- the transaction appears fraudulent or unauthorised;
- age verification requirements cannot be satisfied;
- the order cannot legally be supplied or delivered;
- the order would breach applicable liquor laws or licence conditions;
- the delivery address is outside our service area; or
- another circumstance prevents lawful fulfilment.
If we cancel an order after payment has been received, we will generally refund the amount paid for the cancelled products, subject to applicable law.
37. PROHIBITED USE
You must not use Beerstore.com.au:
- for an unlawful purpose;
- to purchase alcohol for a person under 18;
- to provide false or misleading information;
- to circumvent age-verification requirements;
- to interfere with the security or operation of the website;
- to obtain unauthorised access to our systems;
- to use the website in a way that unreasonably disrupts its operation;
- to conduct fraudulent transactions; or
- in any manner that breaches applicable Australian law.
38. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The updated Terms will be published on Beerstore.com.au and will apply from the date stated at the beginning of the updated Terms.
The Terms applying to an order will generally be those in effect when the order is accepted, unless otherwise required by law.
39. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
To the extent permitted by law, the courts and tribunals of Victoria have jurisdiction in relation to disputes arising from these Terms or your use of Beerstore.com.au.
Nothing in this clause prevents you from exercising any rights available to you under the Australian Consumer Law or other applicable Australian legislation.
40. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary.
The remaining provisions will continue to apply.
41. ENTIRE AGREEMENT
These Terms, together with our:
- Privacy Policy;
- Shipping & Delivery Policy;
- Refund & Returns Policy; and
- any other terms expressly referred to on Beerstore.com.au
form the terms governing your use of Beerstore.com.au and your purchase of products from us.
Where these Terms conflict with a mandatory requirement of Australian law, the mandatory legal requirement will prevail.
